The petitioner has prayed for regular bail in a case instituted for the offence under Sections 341, 323, 324, 307, 354, 354(A), 504/34 of the Indian Penal Code. The allegation against the petitioner along with others unknown is of abusing and assaulting the informant by means of fists and slaps. It is further alleged that the petitioner gave 2-3 knife blows on the head of the informant, due to which he fell down and sustained injuries.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. He submitted that there is no repetition

Patna High Court CR. MISC. No.11868 of 2023(3) dt.23-06-2023 2/2 of any blow by any of the accused persons. As per injury report, the doctor found the injuries, which were sustained to the informant is simple in nature. He is languishing in judicial custody since 06.09.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Supaul in connection with Supaul P.S. Case No. 142 of 2017. (Sunil Kumar Panwar, J) arish/- U T
