The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,504,506 and 354 of the Indian Penal Code and section 3(1)(x)(xi) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The prosecution case is of obstructing irrigation supply by Nitish Kumar when the petitioner assaulted him and abused by calling caste name.

It is submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated since he lodged Barauni P.S. Case No. 128 of 2015 against the informant

Patna High Court Cr.Misc. No.53161 of 2015 (2) dt.23-11-2015 2/2 and his family members. It is further submitted that for petty dispute the accusation has been levelled.

Considering the nature of accusation, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with SC/ST P.S. Case No. 10 of 2015 pending in the court of learned ACJM, Begusarai. This application is disposed of with the aforesaid observation/direction.
