JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 298, 505-C, 504, 506 of the Indian Penal Code.

As per the prosecution case, on 24.02.2021 two messages were received by informant on his cell phone bearing no 700422404, containing threatening, abusive language and also slogans of PFI zindabad and SDPF Zindabad by petitioner. There was also one message about Rinku Sharma (worker of BajrangDal) at Delhi, who had been murdered earlier. It is submitted by the learned counsel for the petitioner that as a matter of fact that the cell phone no 6287772353 has not been used by this petitioner, and the mobile

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Katihar in connection with Katihar Town P.S. case no 91 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
