The petitioner is languishing in custody since 12.11.2018 in a case registered for the offences punishable under Section 414 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that 600 litres of illicit liquor were recovered from the Bolero vehicle of which the petitioner was the driver.

It is submitted by learned counsel for the petitioner that the petitioner was not aware about the consignment of liquor loaded in the Bolero vehicle in question. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the recovery of illicit liquor

Considering the fact that the investigation has already been concluded, statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ VII-cum-Special Judge, Excise Act, Aurangabad in connection with Amba P.S. Case No.104 of 2018.
