The petitioner seeks bail in anticipation of his arrest in connection with Banka P.S. Case No. 10 of 2020 instituted for the offences under Sections 147, 149, 323, 307 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation in the F.I.R. is that Kamal Yadav and Sharad Yadav used their respective weapons to scare the informant and others.

It has been submitted on behalf of the petitioner that though he has been named in the F.I.R. as having

Patna High Court CR. MISC. No.22106 of 2021(2) dt.24-05-2022 2/2 participated in the occurrence, but no overt act has been attributed against him. It has further been submitted that nobody has been injured in the occurrence and the persons with specific accusation have been granted the privilege of anticipatory bail by different Benches of this Court. Regard being had to the facts afore-stated, the petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 10 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
