Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code and u/s 25(1-b)a, 26, 27 35 of Arms Act.

As per the prosecution case, this petitioner along with other FIR named accused persons fired upon the brother and nephew of informant as a result of which they sustained injuries and fell down on the ground.

It is submitted that there is case and counter case in which both sides sustained injuries and injury caused by the petitioner has been found to be simple in nature. Petitioner is in custody since 03.10.2021 and investigation in this case is

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura PS case No. 777/2021.
