Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 Petitioner seeks bail in connection with Khizersarai P.S. Case No. 215 of 2019, registered for the offence punishable under Section 302 of the Indian Penal Code.

As per FIR petitioner happens to be son of the deceased and there is allegation of assault to the deceased, causing his death.

Submission of learned counsel for the petitioner is that there was no intention behind the same and now compromise is reached and petitioner is in custody since 27.7.2019.

Heard learned APP, who has opposed the prayer for bail stating that witnesses have also supported the prosecution case.

In view of above facts and circumstances, I am not

Patna High Court CR. MISC. No.7285 of 2020(3) dt.28-02-2020 2/2 inclined to grant bail to the petitioner. However, once the informant and his family members are examined in this case, petitioner is at liberty to renew his prayer for bail before the trial court itself, who will consider the materials available on the record and pass appropriate order.

Accordingly, this application is dismissed.
