JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 10-07-2019 Although, the agreement period between the petitioner and the respondent Jawahar Navodaya Vidyalaya has expired, learned counsel for the petitioner submits that he is pressing this writ application limited to his grievance that the admitted dues of the petitioner is not being paid by the Principal, Jawahar Navodaya Vidyalaya, Rewar, Post Dumraon via Pakari Brawan, District Nawada (hereinafter referred to as the 'School'). In this connection learned counsel has pointed out
Patna High Court CWJC No.3963 of 2019(2) dt.10-07-2019 2/3 that he has represented to the Principal of the School. Learned counsel for the State is present and submits that, in the facts and circumstances of the case, it is only just and proper if the petitioner approaches the Principal of the concerned School with appropriate materials in support of his claim and the Principal of the School considers the same on the basis of the materials on record.
Having heard learned counsel for the parties and on perusal of the records, this Court thinks it just and proper to grant liberty to the petitioner to make a request to the Principal, Jawahar Navodaya Vidyalaya, Rewar, Post Dumraon via Pakari Brawan, District Nawada with all supporting materials for release of his claims and on such approach being made by the petitioner the Principal of the School shall consider the same independently on the basis of materials available on the record and in case he finds that any amount is admissible and payable to the petitioner, the same must be paid within a period of one month from the date of receipt of the representation/request of the petitioner. In case the claim of the petitioner is not found payable, the petitioner may be communicated with reasons thereof. The petitioner will be at liberty to raise any other grievance in similar manner before the Principal of the School.
