JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks bail in connection with Nardiganj P.S. Case No. 19 of 2014 registered for the offences punishable under sections 323 and 354/511 of the Indian Penal Code.
It has been contended that initially a complaint was filed, which was referred to the police under section 156(3) of the Code of Criminal Procedure pursuant to which the F.I.R. in question was registered. The informant has alleged that the petitioner had teased his daughter Nazma on 6th December, 2013 but the complaint was filed on 10th January, 2014. Patna High Court Cr.Misc. No.51556 of 2014 (2) dt.03-03-2015 2/2 false case in which the petitioner is languishing in custody since 20th September, 2014.
Learned counsel for the informant has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 19 of 2014.
