Petitioner is accused in connection with Alauli P.S. Case No. 219 of 2015 registered under Sections 363 and 364 of the I.P.C.
The accusation is of kidnapping of Gunjan Kumari, minor daughter of the informant, by the petitioner and two others for the purpose of indulging her in immoral traffic act. Learned counsel appearing on behalf of the petitioner submits that the statement of victim Gunjan Kumari was recorded under Section 164 Cr. P.C. during investigation, in which she has stated that she went to Delhi where she called to petitioner at Railway station and stayed with him three days and performed the
Patna High Court Cr.Misc. No.50721 of 2015 (2) dt.04-02-2016 2/2 marriage. Further, submission is that the age of victim has been assessed 18 years at the time of recording her statement on 19.09.2015 and her date of birth is shown as 01.01.1997 in voter identity card.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Khagaria in connection with Alauli P.S.
