The petitioner is apprehending his arrest in connection with Araria Complaint Case No...3825 of 2012 for the offences instituted under Sections 406, 417 and 504 of the I.P.C. The prosecution story, in brief, is that initially the petitioner made an agreement to sell his certain lands to the complainant for consideration amount of Rs.3.25/- lacs and through the said agreement the petitioner received consideration money to the tune of Rs.2.75/- lacs from the complainant but later on the petitioner had sold the land in question to someone other person upon which the complainant when asked for his consideration money from the petitioner the complainant was

Patna High Court Cr.Misc. No.49923 of 2014 (3) dt.04-09-2015 2/2 assaulted by the petitioner with fist and kick and refused to return the same.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the matter relates to civil in nature. The petitioner has denied any agreement between the parties for sale of the land. On behalf of the State it has been submitted that the petitioner is named in the complaint case.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Araria Complaint Case No.3825 of 2012 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.,Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
