ANJANA MISHRA ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

A supplementary show-cause has been filed in the present application duly sworn in by the Executive Engineer, Minor Irrigation Division, Hajipur.

He has also come prepared with a bankers cheque of rupees Six Lakh Twenty Five Thousand Eighty Six only which is being handed over to learned counsel appearing on behalf of the petitioner. The said amount is towards payment of subsistence

Patna High Court MJC No.3933 of 2016 (10) dt.05-04-2018 2/2 allowance for the period on which he was dismissed i.e., 03.12.2013 till 31.01.2012 which is the date of his superannuation. Learned counsel for the petitioner, however, submits that the calculation has not been annexed and as such he is unable to ascertain as to whether the amount which is being paid is correct or not.

In view of the substantial compliance of the order passed by this Court, the present contempt is dropped and the application is disposed of.

Liberty is, however, afforded to the petitioner to raise any other grievance which may be tenable under law and if any amounts which have been found due, the same shall be addressed by the concerned opposite parties.
