The petitioner seeks bail in connection with Parsa Bazar P.S. Case No.144 of 2015 registered under Section 395 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was arrested by the police from his house on 13.09.2015 and since then he is in custody. Further submission is that it would appear from the F.I.R. that the accused persons covering their faces and talking to each other were denoting the name of two accused as Sunil and Srawan and she identified them after unfolding their faces but the petitioner has

Patna High Court Cr.Misc. No.50619 of 2015 (3) dt.08-02-2016 2/2 not been put on T.I. Parade. The informant has stated about sustaining injury by her husband but no description of the injury of her husband has been detailed in the case diary. The statement of the husband of the informant has been detailed in paragraph-8 of the case diary but he has also not stated therein about receiving any injury in course of committing dacoity. The petitioner has no criminal antecedent.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Atul Kumar, Judicial Magistrate, First Class, Patna, in connection with Parsa Bazar P.S. Case No.144 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner.
