The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.
As per the prosecution case, the accused persons which includes the petitioner, his father as also his mother are stated to have assaulted with lathi, iron rod etc. the informant and the members of his family. It is stated that Santosh Singh struck with iron rod causing grievous injury as a result of which his mother was seriously injured. In the occurrence, his father was referred for better treatment to Gorakhpur and from there to Lucknow where he died in hospital.
It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.18983 of 2021(2) dt.14-09-2021 2/2 that the petitioner and the informant side are agnates. The allegations are general and omnibus in nature. The petitioner is in custody since 5.12.2020. He has no criminal antecedent. Chargesheet has been submitted in the case. Co-accused Sharda Nand Singh has been enlarged on bail vide order dated 2.6.2020 passed in Cr. Misc. no.16911 of 2020.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner having remained in custody for over 9 months and grant of bail to co-accused, the Court directs the petitioner to be enlarged on bail in connection with Bhorey P.S. Case no.312 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj.
