JUSTICE SHIVAJI PANDEY ORAL ORDER 27-02-2015 In this case, the petitioner is seeking bail in connection with Banmankhi P.S. Case No. 293 of 1998 registered for offence under section 409 of the Indian Penal Code. It appears from the record that the petitioner was granted bail by this Court vide order dated 11th September 2001 in Cr. Misc. No. 20362 of 2001, accordingly, he was released on bail on 1st October 2001.

As the petitioner was marked absence on 18th December 2003, his bail bond was cancelled. Later on, he was produced before the Trial Court on 23rd August 2007. Again the petitioner was granted bail vide order dated 14th September 2007 in B.P.No. 1064 of 2007 and he was released on bail on 26th September 2007.

Again the petitioner absented from 4th August 2008

Patna High Court Cr.Misc. No.48665 of 2014 (2) dt.27-02-2015 2/2 to 10th June 2010, for that, his bail bond was cancelled on 10th June 2010.

The petitioner was again arrested on 20th September 2014 and since then he is in jail-custody.

Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on or after 1st April 2015 on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Prasant Kumar, Judicial Magistrate 1st class, Purnea in connection with Barmankhi P.S. Case No. 293 of 1998 (G.R. No. 2788/1998), subject to the condition that (i) one of the bailors shall be wife/mother of the petitioner (ii) the petitioner will appear on each and every date before the court below. If he will remain absent on any date, the court below will have liberty to cancel bail bond of the petitioner.
