Petitioner was caught by the informant while he along with one co-accused was going on motorcycle.

Learned counsel for the petitioner submits that it is an admitted case of the prosecution that at the time of arrest of the petitioner, petitioner had fracture on his leg and, as a matter of fact, seized motorcycle was being driven by co-accused which is evident from the first information report itself as it has been mentioned by the informant in the first information report that when the petitioner was asked to disclose about seized motorcycle, he expressed his inability and said that co-accused could say anything in respect of seized motorcycle.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on
