====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-02-2019 Heard learned counsel for the petitioner and counsel appearing on behalf of the State.

The petitioner is in custody in connection with Barauni P.S. Case No. 534 of 2018 for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that in the instant case total 9.36 liters liquor was seized from the open space. Learned counsel for the petitioner further submits that nothing was recovered from the conscious possession of the petitioner. He submits that petitioner is in custody since 28.12.2018.

Considering the quantity of liquor and the fact that petitioner is in custody since 28.12.2018, the Court is inclined to

Sessions Judge-II Cum Special Judge, Excise, Act, Begusarai in connection with Barauni P.S. Case No. 534 of 2018.
