JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Saharsa Sadar P.S. Case No. 910 of 2017 registered for the offences punishable under Sections 420, 406, 467, 468, 471 and 34 of the Indian Penal Code. Allegation against the petitioner is that on the basis of forged document has has taken loan of Rs.40 lacs. Submission of learned counsel for the petitioner is that now there is compromise between the Bank and the petitioner and in the light of the compromise he has deposited 10.5 lac and rest amount he has to deposit by 22.5.2019.

Patna High Court CR. MISC. No.14583 of 2019(4) dt.02-05-2019 2/2 Heard learned APP and learned counsel for the Punjab National Bank. Learned APP has raised an objection that Annexure-2 shows that process under Sections 82 and 83 has already been issued against the petitioner. Learned counsel for the PNB has not controverted the fact that compromise has been made between the petitioner and the Bank and he has deposited part of the amount and rest amount will be deposited by 22.5.2019.

Considering the aforesaid facts and circumstances,, let petitioner surrender within a period of six weeks and pray for regular bail, which shall be considered by the court below in the light of the aforesaid submission and also on the basis of materials available on the record and the court below will pass appropriate order.

With the above observation, this application is disposed of.
