2. Petitioner seeks bail, who is in custody since 28.07.2025, in connection with Samastipur Mufassil P.S. Case No. 318 of 2025, F.I.R. dated 25.07.2025registered for the offences punishable under Sections 103(1), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.

3. Allegation against the petitioner is that he along with his associates have committed the murder of the informant's brother by firearm.

4. Learned counsel for the petitioner submits that it appears from the F.I.R. that the informant is not an eye witness of the alleged occurrence and he has made allegation against the

Patna High Court CR. MISC. No.9628 of 2026(3) dt.06-04-2026 2/2 petitioner on the basis of suspicion and nothing has come during investigation to suggest the involvement of the petitioner in the present occurrence.

5. Learned APP for the State, on the other hand, on the basis of material available on record and case diary, vehemently opposed the prayer for bail of the petitioner and submits that the confessional statement of the petitioner was recorded in paragraph-33 of the case diary in which he has stated that he has committed the present crime in question and on the basis of confessional statement of the petitioner, the arms which was used in the present crime in question has been recovered.

6. Considering the aforesaid facts and circumstances of the case and there is specific and direct allegation against the petitioner, I am not inclined to enlarge the petitioner on bail in connection with Samastipur Mufassil P.S. Case No. 318 of 2025 pending in the Court of learned Additional Judicial MagistrateII, Samastipur.

7. Prayer is refused.
