The matter is being heard through video conferencing due to circumstances prevailing on account of Covid-19 pandemic.
Since both these applications arise out of Nautan P.S. Case No. 464 of 2021, they have been heard together and are
Patna High Court CR. MISC. No.10411 of 2022(2) dt.01-04-2022 2/2 being disposed of by this common order.
The petitioners of both these applications apprehend their arrest in connection with Nautan P.S. Case No. 464 of 2021 registered for the offence under Section 30(d) of the Bihar Prohibition and Excise Act, 2016.
Neither illicit liquor nor any material for manufacturing liquor has been seized from the house of the petitioners and it is contended that they have been falsely implicated by other family members.
Considering the aforesaid facts, both these applications are allowed.
Accordingly, let petitioners of both these applications, above-named, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Nautan P.S. Case No.464 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sandeep Kumar, J) BT/- U T
