JUSTICE PRABHAT KUMAR JHA ORAL ORDER 19-04-2018 The petitioner has filed this petition for modification of the order dated 19.09.2016 passed in C.W.J.C. No.9914 of 2014. Learned counsel for the petitioner submits that the petitioner was directed to file petition within a period of one month from the date of the order with a certified copy of the order then the prescribed statutory authority shall initiate an appropriate proceeding under the provision of the Act, 2011 and the Rules made thereunder, and shall take it to its logical conclusion strictly in accordance with law. It is submitted that since no one was appearing on behalf of the petitioner, therefore, the petitioner could not file petition within one month. The period of filing the petition before statutory authority be extended. Learned counsel for the State did not raise any objection.

Patna High Court MJC No.3662 of 2017 (3) dt.19-04-2018 2/2 Having considered the facts aforesaid, the period of filing petition before the statutory authority is extended for two months from today.

Accordingly, the modification application is allowed to the extent as indicated above.
