JUSTICE RAKESH KUMAR ORAL ORDER 03-03-2015 Heard Sri Kumar Dhirendra Pratap Singh, learned counsel for the petitioner and learned A.P.P. The petitioner, who is in custody since 14.2.2014 in connection with Madhepura P.S. Case No. 322 of 2013 registered for the offence under Section 392 of the Indian Penal Code, has prayed for grant of bail.

Learned counsel for the petitioner submits that F.I.R. was lodged against unknown. However, since the father of the petitioner had lodged a compliant against the officer -in- charge of Madhepura Police Station in the court of learned Chief Judicial Magistrate regarding alleged demand of Rs. 10000/- for releasing a motor cycle, the son of the complainant, who is petitioner, has been victimized and falsely implicated in the present case. He submits that even if for the time being it is

In view of nature of accusation as well as the facts particularly Annexure - 2 to the present petition, the court is of the opinion that it is a fit case for extending the privilege of bail. Let the petitioner namely Rahul Yadav @ Rahul Kumar be enlarged on bail on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S.
