03-12-2015 Heard Sri Abhay Kumar Singh, learned counsel, who was assisted by Sri Rana Baljit Singh, learned counsel for the petitioner and Sri Nand Kumar, learned Addl. Public Prosecutor. The petitioner, who is in custody in Noorsarai P.S. Case No. 256 of 2015 registered for the offence under Sections 414/40 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that though in the F.I.R., it was alleged that one stolen motorcycle was recovered, but it has not been disclosed as to whether the said motorcycle was stolen or not.
Learned Addl. Public Prosecutor has opposed the prayer of bail. He submits that the petitioner is having criminal antecedent and he was arrested on spot alongwith the stolen
Patna High Court Cr.Misc. No.52125 of 2015 (2) dt.03-12-2015 2/2 motorcycle.
Be that as it may, keeping in view the nature of accusation, let the petitioner namely Arun Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Nalanda (Biharsharif)/concerned court in connection with Noorsarai P.S. Case No. 256 of 2015.
