In this case, the petitioner is seeking bail in connection with S.T. no. 507 of 2013 arising from Benipatti P.S. Case No. 40 of 2013 registered for offence under section 304(B)/34 of the Indian Penal Code.
The petitioner had earlier moved before this Court in Cr. Misc. No. 39743 of 2014 and the Court rejected the bail of the petitioner.
This Court, vide order dated 13/01/2016, called for the present status report from the court of A.D.J.-VII, Madhubani who has reported that seven witnesses have been examined by the prosecution.
In such view of the matter, this Court is not inclined
Patna High Court Cr.Misc. No.52670 of 2015 (3) dt.03-02-2016 2/2 to grant bail to the petitioner. Accordingly, this petition is dismissed. However, direction is given to the court below to complete the trial within a period of three months from the date of receipt/production of a copy of this order.
