The petitioner has prayed for bail in connection with Patahi P.S. Case No. 200 of 2017 instituted for the offence under Sections 341, 342, 323, 324, 307, 379, 504, 506, 120(B)/34 of the Indian Penal Code.

As per allegation in the FIR, the informant alleged that while she was going to Bakhari, in the way, the petitioner armed with knife stopped her and 3-4 unknown persons caught him. Thereafter, the petitioner stabbing upon the informant by means of knife on the his several parts of the body due to which he sustained injuries. It is further alleged that the accused persons also snatched her ornaments and cash of Rs.

It is submitted by learned counsel for the petitioner that petitioner has committed no offence. The petitioner is pattidar of the informant and he has been falsely implicated in this present case due to land dispute. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the Petitioner is languishing in custody since 25.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner has made direct allegation against the petitioner is of stabbing by means of knife due to which he sustained injuries on several parts of the body. The injury report of the informant which is annexed with the case diary supported the prosecution allegation wherein, the informant is alleged to be sustained eight injuries out of which three injuries are on vital parts which are grievous in nature caused by sharp cutting object. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
