JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-10-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report but in course of investigation, the statement of informant u/S 164 of the Cr. P.C. was recorded, in which, the informant stated that before leaving the home, the deceased had disclosed that petitioner No. 1 asked him on telephone to meet Jamal Mukhiya and furthermore, it also came to light that the deceased was in love with daughter of co-accused, Jamal Mukhiya and, that was the reason, petitioners and other accused committed the murder of the deceased.

Learned counsel for petitioners submits that petitioners do not have any concern with Jamal Mukhiya and moreover, except suspicion, there appears to be nothing against

The investigation against petitioners has already been completed and charge sheet has been submitted. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Azamnagar P.S. Case No. 53 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Katihar. (Hemant Kumar Srivastava, J) A.K.V./- U T
