Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.

For trivial dispute, petitioner allegedly assaulted to the informant, a driver of the truck. The doctor has found several lacerated wound, including wound on the vital part of the body of the deceased.

Submission is that allegation is of commission of assault with Farsa, which is a sharp cutting weapon. However, the doctor has not found any injury caused by Farsa. Moreover, petitioner is in custody since 05.11.2018. Investigation of the case is already complete. Petitioner has got no criminal

Considering the entire facts of this case, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Raxaul Police Station Case No.322 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
