Victim was produced before the police by her parents and her statement under section 164 of the Cr.P.C was recorded in which she stated that she was taken away by the petitioner to Delhi where she was confined in a room but, any how, she gave information to her parents in respect of her confinement and after that her parents came there and took her to her home. Victim was medically examined and she was found between 17 to 18 years.

Learned counsel for the petitioner submits that victim and the petitioner are relative and even if statement of the victim assumed to be true, then also, petitioner did nothing wrong with the victim. Moreover, parties have already compromised the case. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that

No.32944 of 2015 (3) dt.16-10-2015 petitioner is in jail custody since 13.5.2015, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Suvash Kumar Ray, Judicial Magistrate, Ist Class, Muzaffarpur/ concerned court in Piar P.S. Case no. 67/2014.
