The petitioner seeks bail in a case instituted for the offences under Sections 406, 409, 420, 411, 413, 414, 120(B) of the Indian Penal Code, Sections 47(F), 13(F), 48 of the Excise Act and Rule 2(5), 3 and 5 (Kh) of the Bihar Rajya Mahua Phul Act and Section 7 of the Essential Commodities Act.
The police has raided the house of the petitioner and from there six drums of Kerosene Oil as well as 11 bags of Mahua has been recovered. The petitioner has no criminal antecedent and he is in jail since 10.9.2015. Having considered facts and circumstances of the case, let petitioner, Girdhari Yadav, be released on bail on
Patna High Court Cr.Misc. No.51036 of 2015 (2) dt.10-11-2015 furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Gaya in connection with Konch P.S. Case No.191 of 2015, subject to the conditions that (i) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (ii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
