Petitioner is in jail custody since 7.8.2015 on the accusation that one 9 m.m. loaded pistol containing two cartridges was recovered from his conscious possession when he was caught in the house of one Shiv Kumar Saha, who was an accused in Sukhani P.S.Case No. 196 of 2015.

The contention on behalf of the petitioner is that petitioner was tenant of the aforesaid Shiv Kumar Saha and as a matter of fact, police had gone to arrest Shiv Kumar Saha but apprehended the petitioner when failed to nab the aforesaid Shiv Kumar Saha and booked the petitioner in this case false case. Considering the aforesaid facts and circumstances as

No.53199 of 2015 (2) dt.24-11-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S.Case No. 320 of 2015.
