JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 Petitioners seek bail in connection with Special Case No. 569 of 2019, arising out of Rail Kiul P.S. Case No. 220 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 48 and 44 litres of liquor from petitioner Nos.1 and 2 respectively while travelling in a train.

Submission of learned counsel for the petitioners is that the allegation is false and they are in custody since 28.12.2019, having no criminal antecedent.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.8778 of 2020(2) dt.28-02-2020 2/2 petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Excise, Lakhisarai, in connection with Special Case No. 569 of 2019, arising out of Rail Kiul P.S.
