The petitioner is languishing in jail since 21.02.2015 in a case instituted under Sections 147, 148, 149, 121, 121(A), 307 and 120(B) of the Indian Penal Code and Sections 3/4 and 5 of the Explosive Substance Act and Sections 16, 18, 20, 21 and 22 of the U.P.A.Act.
As per allegation, it is a case of assault upon the informant and also recovered some arms and ammunition from the possession of the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.02.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of
Patna High Court Cr.Misc. No.29632 of 2015 (3) dt.16-10-2015 evidence against the petitioner. It is further submitted that the petitioner may be released after completion of nine months in custody from 21.02.2015.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, it is directed that the petitioner be released after completion of nine months in custody from 21.02.2015 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction learned Sessions Judge, Jamui in UAP Case No.35 of 2015 arising out of Barahat P.S.Case No.03 of 2015.
