The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 354, 379 and other allied sections of the Indian Penal Code. As per the FIR, petitioner is alleged to have assaulted on the head of informant by means of iron rod. It is submitted that due to land dispute casual Marpit took place between the parties, as a result of which both parties sustained injuries. There is case and counter case. Injuries attributed to this petitioner is simple in nature. After investigation, the police did not find the case true under Sections 379 and 354 of the IPC. Petitioner claims clean antecedent.

No.8948 of 2022(3) dt.15-09-2022 2/2 Considering the nature accusation, nature of injury coupled with the fact that petitioner claims clean antecedent, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Basantpur Lakari Naviganj P.S. Case No. 190 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
