Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Chawk P.S. Case No. 102 of 2021 registered for the offences punishable under Sections 302, 201, 120B, 307 of the Indian Penal Code.

Allegedly this petitioner and co-accused persons murdered the informant's son died assaulting him by means of washing basin, brick and stone.

The main submissions advanced by learned counsel for the petitioner are that one co-accused namely Aakash Kumar

Patna High Court CR. MISC. No.9239 of 2022(2) dt.29-06-2022 2/2 @ Ghapalu has been granted regular bail by a co-ordinate bench of this Court vide order dated 24.3.2022 passed in Cr. Misc. 48921 of 2021 the informant is not the eye witness of the alleged occurrence and petitioner has been languishing in jail since 30.3.2021 and cause of evidence has not been mentioned in the FIR.

Learned APP has opposed the prayer for bail.

Heard both the sides and perused the FIR and seizures of some articles recovered during the course of investigation. The present case relates to murder there is a serious and direct allegation against the petitioner and he allegedly assault the informant's son by means of washing basin and during the course of investigation blood stained cloth of this petitioner and articles used in assaulting the deceased were recovered and in following with the disclosure statement and as per paragraph no. 3 of this petition there are criminal antecedent of two cases against the petitioner considering all these facts, in the opinion of this Court it is not a fit case for grant of bail. Accordingly his prayer for bail stands rejected.
