The petitioner seeks regular bail in connection with Hathidah P.S. Case No. 38 of 2018 (Special Case No. 5016 of 2018) registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 43.125 litres of illicit liquor from the house of one Rabindra Singh and upon enquiry the villagers are said to have disclosed the name of six co-accused persons including the petitioner herein who are said to be the real owner of the said illicit liquor. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It
Patna High Court Cr.Misc. No.9286 of 2019(2) dt.18-02-2019 2/2 is further submitted that the petitioner is accused in one another case in which he is on bail. Lastly, it is submitted that the petitioner is languishing in custody since 15.01.2019. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Hathidah P.S. Case No. 38 of 2018 (Special Case No. 5016 of 2018).
