====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-01-2022 Heard Mr. Basant Kumar Mishra, learned Advocate for the petitioner and Dr. Ajeet Kumar, learned Additional Public Prosecutor for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Goraul P. S. Case No. 312 of 2019 instituted for the offences under Sections 338, 341, 323, 353, 307, 427, 504, 506 and 120B of the Indian Penal Code.

Though the petitioner has been named in the F.I.R. along with several others, but there is no specific accusation against him.

It has further been submitted that the F.I.R. does not disclose the reason for the villagers in large numbers to have assembled before the police station and assaulting five of such police men posted at that station.

He was not even present in his village when the occurrence took place. Apart from this, it has been submitted that several other accused persons with similar allegation have been granted anticipatory bail by different Benches of this Court.

The petitioner does not have criminal antecedent. Considering the afore-noted submissions, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Vaishali, Hajipur in connection with Goraul P.S. Case No. 312 of 2019 , subject to the condition as laid down under Section 438 (2) Cr. P.C. The application stands allowed.
