The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 414, 504 of the Indian Penal Code and 25(1-B)a/26 of the Arms Act.
It is alleged that the petitioner while travelling on motorcycle resorted to fire on Raj Kumar in the background of land dispute and subsequently threw the pistol in the premises of Allahabad Bank.
It is submitted by learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner. The motorcycle was registered in the name of
Patna High Court Cr.Misc. No.51007 of 2015 (2) dt.06-11-2015 2/2 the mother of the petitioner and the same has been released in favour of his mother.
Let the learned court below consider the prayer for regular bail of the petitioner keeping in view of the fact that the petitioner has no criminal antecedent, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Khudaganj P.S. Case No. 07 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Hilsa, Nalanda.
With the aforesaid observation, this application is disposed of.
