Perused the impugned order dated 31.08.2016 passed by Munsif-II, Munger in Eviction Suit No.02 of 2014 whereby the court below has allowed the amendment application filed by the plaintiff-respondent.

At the time of hearing of this civil miscellaneous application the learned counsel for the petitioners submitted that only issues have been framed and evidence has not yet started. Therefore, in view of the submission of learned counsel for the petitioners the amendment allowed is a pre-trial amendment as trial has not commenced. Therefore, there is no question of prejudice to the petitioners arises.

Accordingly, this civil miscellaneous application is dismissed.
