Petitioner is accused in connection with Garhpura P.S. Case No. 95 of 2013 registered under Sections 448, 341, 323, 307, 325, 504 and 506/34 of the I.P.C.
The allegation is that the on 17.08.2013, when the informant/deceased was at his door, his neighbour Md. Nayeem asked to expend money then he refused. Thereafter, Md. Nayeem assaulted him through slap on which the informant/deceased made protest, in that course, Md. Nayeem called his son and others, and assaulted through fists and slaps. At that time, Md. Asif and Md. Nayeem both pressed the chest of the informant. Anyhow, he was saved and admitted to the hospital and later on, he died in course

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the occurrence took place on 17.08.2013 and F.I.R. has been lodged by the informant/deceased on 18.09.2013, after lapse of one month. Moreover, it would also appear from the F.I.R. that there is general allegation against the petitioner, who is lady, to cause injury through fists and slaps with specific allegation against coaccused, Md. Nayeem and Md. Ashif to press the chest of the informant. It is also submitted that petitioner is in custody since 31.08.2015.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Begusarai in connection with Garhpura P.S. Case No.95 of 2013. (Rajendra Kumar Mishra, J) Shail/- U T
