Ms. Suman Kumari Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-06-2020 Heard Mr. Anil Kumar Singh, learned counsel for the petitioner and Ms. Suman Kumari Singh, learned APP for the State.
The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 783 of 2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Amendment Act, 2018.
Though only 12 litres of liquor is said to have been recovered from behind the half constructed house of the petitioner, but considering the fact that the petitioner was earlier made an accused in a case of similar nature, I am not inclined to grant anticipatory bail to him.
Accordingly, prayer for anticipatory bail is rejected.
Patna High Court CR. MISC. No.7594 of 2020(2) dt.10-06-2020 2/2 In case the petitioner surrenders before the court below and prays for bail, that petition shall be considered on its own merits without being prejudiced by the fact that the present petition has not been entertained.
