JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with Jagdishpur P. S. Case No.10 of 2014 registered for the offences punishable under Sections 498(A), 328, 307 of the I.P.C. and later on, Section 302 of the I.P.C. was also added.

Petitioner is the husband of the deceased and is facing trial.

Learned counsel for the petitioner submits that the petitioner is in custody since 10.09.2015 and till date, six witnesses have been examined, except the I.O. and the doctor. The date of their evidence were fixed on 12.10.2018, but till date, they have not appeared for their deposition and on account of non-appearance of the official witnesses, the petitioner is

The Superintendent of Police, Bhagalpur is directed to ensure the presence of the I.O. and the doctor for their evidence. The Superintendent of Police, Bhagalpur will also ensure that the proceeding before the Court below culminates expeditiously, in the event the trial is not concluded within a period of eight months from today, the petitioner will be at liberty to move the Court for renewing his prayer for regular bail. The application stands disposed off.
