Heard learned counsel for the petitioners as well as the learned APP for the State.
The petitioners apprehend their arrest in connection with Siwan Muffasil P.S. Case No. 185 of 2021, registered for
Patna High Court CR. MISC. No.9155 of 2022(2) dt.08-09-2022 2/3 the offences punishable under Sections 380, 323, 448, 379/34 of the Indian Penal Code and Sections 3, 4 and 5 of Prevention of Witch Craft (Daain) Practice Act, 1999.
The complaint petition has been filed by one Durgawati Devi with allegation that the accused persons were making allegation that the complainant was applying some supernatural powers due to which the family members of the petitioner became ill. The accused persons assaulted the complainant and her daughter Anita Kumari. They also took rupees fifty thousand from their house.
Learned counsel for the petitioner has submitted that there is delay in lodging the complaint petition and the petitioners are the persons of clean antecedent. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan in connection with Siwan Muffasil P.S. Case No. 185 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the
Patna High Court CR. MISC. No.9155 of 2022(2) dt.08-09-2022 3/3 petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
