The petitioner seeks bail in Ramnagar P.S. Case No. 217/2014 registered under Section 302 and other sections of the Indian Penal Code.
The informant disclosed that his cousin informed him that his son was not well. He along with other co-villagers enquired from Krishna Parit the petitioner who disclosed that he would get the dead body of his son at 3.30 a.m. and on such disclosure the dead body of the deceased was recovered. It is submitted that same and similar allegation is made against all the accused persons namely, Kailash Pandit, Birendra Pandit who had already been granted anticipatory bail vide order
Patna High Court Cr.Misc. No.54487 of 2015 (2) dt.04-05-2016 2/2 passed in Cr. Misc. 8048/2015. Petitioner is in jail since 10.10.2014 and the trial has not been concluded. It appears that of course, the allegation is made against the accused persons, but it was the petitioner who confessed his guilt and in pursuance thereof, the dead body of the deceased was recovered. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. The Trial Court is directed to expedite the trial and conclude the same within nine months from the date of receipt/production of a copy of this order.
