The petitioners are apprehending their arrest in connection with Excise Case No.1800 of 2018 arising out of Bihiya (Bahoranpur) P.S.case No.422 of 2018 registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act..

Allegation against the petitioners is about recovery of 397 and odd lts. of liquor from the toilet of the petitioner. Submission of the learned counsel for the petitioners is that the toilet is situated outside the house of the petitioner and he has falsely been implicated in this case and having no criminal antecedent.

Patna High Court CR. MISC. No.18062 of 2019(3) dt.23-09-2019 2/2 Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the recovery is from his house.. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners. With the aforesaid direction, this application is dismissed.
