====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-04-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in case registered for the offence punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, three unknown miscreants tried to snatch motorcycle of the informant on the point of pistol and also assaulted him by the butt of pistol.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during course of investigation on the basis of confessional statement of co-accused. No incriminating material has been recovered from the conscious possession of the petitioner.

5. However, learned A.P.P. for the State opposed the bail application and submitted that this petitioner along with

Patna High Court CR. MISC. No.11511 of 2024(3) dt.16-04-2024 2/2 other accused persons assaulted the informant with the butt of pistol and tried to snatch his motorcycle. He next submits that petitioner has got one criminal antecedent of similar nature.

6. Considering the nature of accusation and criminal antecedent, prayer for anticipatory bail of the petitioner is refused.
