The petitioner seeks bail in connection with LNMU P.S. case no. 219 of 2015, registered under Section 379/411 of the IPC.

The informant has alleged that while he was travelling on a bus he was made to sleep by spraying some materials. When he gained consciousness, it was found that the bag containing the mobile and laptop was missing. On 10.09.2015, the stolen articles are said to have been recovered from the house of the petitioner.

It is contended that there is nothing on record to show that the house was in exclusive conscious possession of the petitioner. He carries no criminal antecedent and is languishing in

Patna High Court Cr.Misc. No.51698 of 2015 (3) dt.15-12-2015 2/2 jail custody since 10.09.2015.

Considering the facts and circumstances of the case, this Court is inclined to extend the privilege of bail to the petitioner. Let the petitioner, named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with L.N.M.U. P.S. case no. 219 of 2015, with following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.

(ii) As soon as the charges are framed the petitioner shall appear in person before the trial court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law (Kishore Kumar Mandal, J) Shyam/- U T
