The petitioner has filed this Civil Miscellaneous petition against the order dated 09.03.2018 passed in Civil Misc. Case No.32 of 2018 by learned District Judge, Jehanabad, by which the learned District Judge, Jehanabad has rejected the petition of the petitioner to transfer the case record of Title Suit No.284 of 2013 from the court of Sub-Judge-I, Arwal to any other competent court.

Learned counsel for the petitioner submits that the conduct and gesture of Sub-Judge-I, Arwal creates reasonable doubt in the mind of the petitioner who is defendant in the court below that he may not get justice from the court of Sub-Judge-I, Arwal. Learned counsel for the petitioner further placed reliance in the case law, reported in 2006(4) SCC Page 513. Having considered the aforesaid facts, I do not find any

Patna High Court C.Misc. No.896 of 2018 (2) dt.31-07-2018 2/2 substance that the conduct and gesture of Sub-Judge-I, Arwal caused any reasonable apprehension in the mind of the petitioner. There is no material on record to show such conduct and gesture of the learned Sub-Judge and thus this Civil Miscellaneous petition is dismissed as devoid of any merit. (Prabhat Kumar Jha, J) Amit/- U
