The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 447, 307, 354, 504, 506/34 of the Indian Penal Code. Though allegation against the petitioner and coaccused Anandi Mandal is of commission of assault with iron rod and tangi at the head of the wife of the informant but the doctor has found single head injury which was lacerated skin deep. It is difficult to attribute which of the two accused caused the single head injury to the wife of the informant. Considering the aforesaid facts, let the petitioner, above named, who has got no criminal antecedent, in the event of his arrest or surrender before the Court below within a period
Patna High Court Cr.Misc. No.9684 of 2019(2) dt.19-02-2019 2/2 of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Sono Police Station Case No. 280 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
