JUSTICE ARVIND SRIVASTAVA ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in connection with Hathua P.S. Case No. 44 of 2020 registered under Sections 302, 120B and 34 of the Indian Penal Code read with Section 27 of the Arms Act.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case due to political vendetta. There is general and omnibus allegation against the petitioner.

Learned A.P.P. appearing on behalf of the State and learned counsel for the informant opposed the prayer of the petitioner by contending that there is direct allegation of

Patna High Court CR. MISC. No.19776 of 2021(4) dt.24-02-2022 2/2 gunshot against the petitioner to the deceased (brother of the informant). Hence, petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the above facts and circumstances of the case and submissions advanced on behalf of the learned counsels for the opposite party, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected.
