The petitioner seeks regular bail in connection with Rampur P.S. Case No. 391 of 2020 instituted for the offences under Sections 420 and 120(B) of the Indian Penal Code read with Section 10 of Bihar Conduct of Examination Act, 1981. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant who is an A.S.I. in Rampur Police Station had alleged that he reached Gaya College based on a secret information and on seeing police two persons, namely, Amit Kumar and Shiv Raj Kumar started fleeing but were arrested and on search of mobile phone of Amit Kumar, answer of examination paper which was going to be held on that very day was found and

No.19639 of 2021(2) dt.15-11-2021 2/2 on being interrogated he disclosed the name of the mastermind as Ranjit Kumar @ Gore Mamu (petitioner) and that he is sending the answer of the question paper on his mobile. Learned counsel for the petitioner submits that the name of this petitioner came on the confessional statement of Amit Kumar and Amit Kumar has been granted bail by this Court vide order dated 08.07.2021 in Cr. Misc. No. 20950 of 2021 and the petitioner is in custody since 18.12.2020 and charge-sheet has been submitted in this case.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 18.12.2020, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing of bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 391 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
